Terms of Service

The short version: use Anchori lawfully, pay your subscription on time, and your audit data stays yours. We run the platform; you own what you put in it.

1. Acceptance

By accessing or using Anchori, you agree to be bound by these Terms of Service and our Privacy Policy. If you are accepting on behalf of an organisation, you represent that you have authority to bind that organisation. If you do not agree, do not use Anchori.

2. The Service

Anchori is a cloud-based safety audit and inspection management platform. It includes audit template creation, mobile audit conduct with offline support, photo and GPS capture, digital signature collection, findings management, scheduled inspections, team management, and compliance reporting.

Features available to you depend on your subscription plan. We may update, add, or remove features at any time. We will give reasonable notice of changes that materially reduce functionality.

Not compliance advice. Anchori is a tool to help you conduct and record audits. It does not constitute legal, safety, or regulatory compliance advice. You remain responsible for meeting all applicable laws and regulations in your jurisdiction.

3. Subscription Plans and Pricing

All prices are in Australian dollars (AUD) and exclude GST. GST (10%) will be added for Australian customers at checkout. Prices for users outside Australia are displayed in their local currency or AUD as applicable. We reserve the right to change prices with 30 days' notice to existing subscribers.

4. Payment and Billing

Subscriptions are billed in advance on a monthly or annual cycle from the date you subscribe. Payment is processed by our third-party payment provider. By subscribing, you authorise us to charge your nominated payment method for the applicable fees on each billing date.

If a payment fails, we will attempt to notify you and retry. Continued failure to pay may result in suspension or downgrade of your account. You are responsible for keeping your payment details current.

5. Free Trial

Where a free trial is offered, it is available to new subscribers only. At the end of the trial period, your subscription will automatically convert to the paid plan at the advertised rate unless you cancel before the trial ends. No charge is made during the trial.

6. Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain full access until then.

We do not provide refunds for partial billing periods. Annual subscriptions cancelled before the renewal date are not refunded for the remaining term, unless required by Australian Consumer Law.

If we cancel your account for breach of these Terms, no refund is provided. If we cancel your account for any other reason (for example, we discontinue the service), we will provide a pro-rata refund of prepaid fees.

7. Your Data

You retain ownership of all data your organisation uploads to Anchori — audit records, templates, photos, findings, and reports. You grant us a limited, non-exclusive licence to store, process, and transmit your data solely to provide and improve the service.

You are responsible for the accuracy, legality, and appropriateness of data you upload. You must not upload data that you do not have the right to share, or that violates applicable laws.

On account closure, we will make your data available for export for 30 days before deletion. Contact us at anchoriintel@gmail.com to arrange an export.

9. Intellectual Property

The Anchori platform — including its design, features, code, trademarks, and content we create — is the intellectual property of Anchori Intel. These Terms do not grant you any rights to our intellectual property beyond using the service as permitted here.

You retain all rights to content and data you create or upload.

10. Uptime and Availability

We aim to keep Anchori available and reliable, but we do not guarantee uninterrupted access. We perform maintenance from time to time, which may result in brief service interruptions. We will endeavour to schedule maintenance outside peak hours and give advance notice where possible.

11. Limitation of Liability

To the maximum extent permitted by Australian law, Anchori Intel's total liability to you for any claim arising from these Terms or your use of Anchori shall not exceed the total fees you paid in the 12 months immediately preceding the claim.

We are not liable for indirect, incidental, consequential, special, or punitive damages, including loss of profit, loss of data, or business interruption, even if we have been advised of the possibility of such damages.

Nothing in these Terms limits liability that cannot be excluded under Australian Consumer Law, including guarantees for services of a kind ordinarily acquired for personal, domestic, or household use.

12. Warranties Disclaimer

Anchori is provided "as is" and "as available". We make no warranty that the platform will be error-free, uninterrupted, or meet your specific requirements. We do not warrant that audit results produced through Anchori constitute legal compliance with any safety regulation, standard, or law. You should obtain independent legal or safety advice for regulatory compliance matters.

13. Indemnity

You agree to indemnify and hold harmless Anchori Intel, its officers, and contractors from any claims, losses, or damages arising from your breach of these Terms, your misuse of the platform, or content you upload that infringes a third party's rights.

14. Termination

Either party may terminate the agreement at any time. You may terminate by cancelling your subscription and closing your account. We may terminate or suspend your account immediately for breach of these Terms, non-payment, or illegal use. Where practicable, we will give you notice and an opportunity to remedy a breach before termination.

On termination, your right to access the platform ceases. Sections covering data, intellectual property, limitation of liability, and governing law survive termination.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email and in-app notice at least 14 days before they take effect. Continued use of Anchori after changes take effect constitutes acceptance. If you do not agree with material changes, you may cancel your subscription before they take effect.

16. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms or your use of Anchori shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.

If you are a consumer in another jurisdiction, you may also have rights under the laws of that jurisdiction that we cannot exclude.
